Your Rights Under GDPR

As a user in the European Union or European Economic Area, you have specific rights regarding your personal data under the General Data Protection Regulation (EU) 2016/679 ("GDPR"). This page explains each right and how to exercise it.

Jim is a free, personal project by Ruben Swidzinski. Despite being a personal project, I take your data rights seriously and will respond to all requests promptly.

1. Right of Access (Article 15)

You have the right to obtain confirmation as to whether your personal data is being processed and, if so, to access that data along with:

  • The purposes of the processing
  • The categories of data concerned
  • The recipients or categories of recipients
  • The retention period or criteria for determining it
  • Your other rights (rectification, erasure, restriction, objection)
  • The source of the data (if not collected from you directly)

How to exercise: Email me at [email protected] with the subject "Data Access Request". I will provide your data within 30 days.

2. Right to Rectification (Article 16)

You have the right to have inaccurate personal data corrected and incomplete data completed.

How to exercise: Most profile data can be corrected directly in the App via Profile > Settings. For data that cannot be self-corrected, contact me.

3. Right to Erasure / Right to Be Forgotten (Article 17)

You have the right to request deletion of your personal data when:

  • The data is no longer necessary for its original purpose
  • You withdraw consent (and there is no other legal basis)
  • You object to processing and there are no overriding legitimate grounds
  • The data has been unlawfully processed

How to exercise: You can delete your account from Profile > Settings > Delete Account. This will permanently delete all your personal data within 30 days. Alternatively, email me to request erasure.

4. Right to Restrict Processing (Article 18)

You have the right to restrict the processing of your personal data when:

  • You contest the accuracy of the data (restriction during verification)
  • Processing is unlawful but you prefer restriction over erasure
  • I no longer need the data but you need it for legal claims
  • You have objected to processing (restriction pending verification)

5. Right to Data Portability (Article 20)

You have the right to receive your personal data in a structured, commonly used, and machine-readable format (JSON), and to transmit it to another controller. This applies to data you provided to me that is processed based on consent or contract.

This includes:

  • Profile and onboarding data
  • Workout sessions and exercise logs
  • Nutrition logs and daily targets
  • Body metrics and measurements
  • Workout plans and progression data
  • AI chat history
  • Achievement and streak data

How to exercise: Email me with the subject "Data Export Request". I will provide a JSON export within 30 days.

6. Right to Object (Article 21)

You have the right to object to processing of your personal data based on legitimate interests. Upon objection, I will stop processing unless I can demonstrate compelling legitimate grounds that override your interests.

How to exercise: Contact me specifying which processing you object to and why.

7. Right to Withdraw Consent (Article 7(3))

Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing performed before the withdrawal.

How to exercise:

  • Cookie consent: Update preferences via the cookie banner or Cookie Policy page.
  • Health data consent: Contact me to withdraw consent for health data processing. Note that this will effectively require account deletion, as health data processing is core to the App's functionality.
  • Partner data sharing: Unlink your partner in Profile > Couple settings.

8. Right Not to Be Subject to Automated Decision-Making (Article 22)

You have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. Jim's automated features (AI coach, workout plan generation, fatigue scoring) are advisory tools that provide suggestions — they do not make binding decisions about you.

9. Right to Lodge a Complaint (Article 77)

If you believe your data protection rights have been violated, you have the right to lodge a complaint with a supervisory authority. For users in Belgium:

You may also lodge a complaint with the supervisory authority in your country of residence or place of work.

10. Response Times

I will respond to all data subject requests within 30 days of receipt. If a request is complex, I may extend this by a further 60 days, but I will inform you of the extension within the initial 30-day period.

11. Identity Verification

To protect your privacy, I may need to verify your identity before processing a request. I will ask you to confirm your identity from the email address associated with your account.

12. No Fee Required

I will not charge a fee for exercising your rights, except where requests are manifestly unfounded or excessive (e.g. repetitive requests), in which case I may charge a reasonable fee or refuse the request.
